Planit Food Retail Private Limited (“PLANIT” or the “Company”, also referred to as “we” and “our” in this document) is the licensed owner of the brand Planit and the website planit.club (the “Website”). You are a customer of the Company or a visitor to the Website and as such are advised to read the Term & Conditions carefully. By accessing the services provided by the Website you agree to the terms provided in this Terms & Conditions document.

 

Eligibility

Services of the Website would be available to only select geographies in India. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 are not eligible to use the Website. If your age is below 18 years your parents or legal guardians can transact on your behalf, if they are registered users.

 

License & Website access

PLANIT grants you a limited sub-license to access and make personal use of the Website. You may not:

• Download the Website (other than page caching) or modify it, or any portion of it, except with express written consent of PLANIT
• Engage in commercial use of the Website or any of its contents;
• Download or copy account information for the benefit of another merchant
• Use data mining, robots, or similar data gathering and extraction tools on the Website
• Frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of the Website or of PLANIT and its affiliates without express written consent.
• Use any meta tags or any other "hidden text" utilizing the Website’s or PLANIT’s name or trademarks without the express written consent of PLANIT.

Any unauthorized use terminates the permission or sub-license granted by PLANIT under this Terms & Conditions document.

 

You may not use the Website for any of the following purposes:

1. Disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material.
2. Transmitting material that encourages conduct that constitutes a criminal offence or results in civil liability or otherwise breaches any relevant laws, regulations or code of practice.
3. Gaining unauthorized access to other computer systems.
4. Interfering with any other person's use or enjoyment of the Website.
5. Breaching any applicable laws;
6. Interfering or disrupting networks or web sites connected to the Website.
7. Making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner.

 

Objectionable Material

You understand that by using this Website or any services provided on the Website, you may encounter Content that may be deemed by some to be offensive, indecent, or objectionable, which Content may or may not be identified as such. You agree to use the Website and any service at your sole risk and that to the fullest extent permitted under applicable law, PLANIT and its affiliates shall have no liability to you for Content that may be deemed offensive, indecent, or objectionable to you.

 

Account & Registration Obligations

You are required to register and login for placing orders on the Website. You have to keep your account and registration details current and correct for communications related to your purchases from the Website. You are solely responsible for maintaining the confidentiality and security of your account including username, password and payment information. PLANIT is not responsible for any unauthorised use of your account.

 

Personal Information

As part of the registration process on the Website, PLANIT may collect the following personally identifiable information about you:

• Name
• Primary and alternate email address
• Primary and alternate mobile phone number
• Primary and alternate billing and delivery addresses
• Demographic information (including your age, gender, occupation and education among others)
• Details of your family members (such as names and mobile numbers)
• Information about the pages on the site you visit /access, the links you click on the site, the number of times you access the page and any such browsing information
• Details of the transactions you conduct through the Website (such as products and services you purchase, the frequency and quantity of purchases, product returns)
• Details of information submitted by you voluntarily on the site (such as product ratings and reviews, recipes and comments)
• Details of your customer service interactions with us, including complaints and feedback submitted by you, email and other communications sent by you to the Company and by the Company to you, chat transcripts and telephone calls between you and the Company)

 

Promotional Communications

By agreeing to the terms and conditions, you agree to receive promotional communication from us to your registered email addresses, mobile phones and addresses. You can opt out either by unsubscribing in "My Account" or by contacting customer service. 

 

Product offerings

We offer a range of food ingredients, semi-prepared and fully prepared food products and kitchen and dining tools and consumables that support the storage, preparation and consumption of food. The nature of products we offer, including fresh fruit and vegetables, artisanal clean-label prepared foods, and imported foods and food ingredients, are subject to inherent variability in product quality and availability. While each product goes through a stringent quality control process before its delivery to you, we cannot guarantee the uniformity of size, grade, taste and physical appearance that is normal in mass-manufactured processed foods.

 

Content accuracy

You agree and accept that content (including text, images, and video) about the products that appears on the Website is representative of the product and the product delivered by us to you may differ from this representation.

 

We provide information about the products we list based on research from multiple sources, including nutritional information, health benefits, allergy information and the like to support your purchase, preparation and consumption experience. While we make best effort to use credible sources for this research, we do not provide any assurances as to the completeness or accuracy of this information. Our Content is not a substitute for the diagnosis, treatment or advice of a qualified medical professional.

 

Pricing

Pricing for products on the Website may be different from prices for the same product from other sellers. Prices are subject to change without advance notice. Our products are liable for taxes, as applicable in India.

 

All the products listed on the Website will be sold at the prices at which they are listed at the time of ordering. You understand and agree that prices of our products may be higher or lower than the prices you have ordered at on the date of delivery, and no additional charges will be collected or refunded as the case may be at the time of the delivery of the order.

 

All prices on the Website are in Indian Rupees. For international cards used on the site, the bank’s applicable exchange rate and charges may apply. We have no jurisdiction on this and any disputes or queries on exchange rates and bank charges need to be directed to the bank or institution that issued your card or payment instrument.

 

Delivery charges may be applicable on your order if the value of the order is below a threshold amount or if you desire delivery in a slot not otherwise available for your delivery location. Where applicable, delivery charges will be displayed to you on the Website’s checkout page prior to order placement.

 

Ordering

Before placing an order it is your responsibility to check the product description on the Website. By placing an order for a product you agree to be bound by the conditions of sale included in the item's description.

 

Order Cancellation and Modification by Customer

Orders once placed can not be modified or cancelled.

 

Order Cancellation by Company

PLANIT reserves the right to cancel part or all of your order any time before delivery where we are unable to deliver your order for any reason whatsoever. In such a case we will refund any payments already made by you for the order. We will attempt to pre-inform you if part or all your order is cancelled by us.

 

Fraudulent Transactions

If we suspect any fraudulent transaction by any customer or any transaction which contravenes the terms & conditions of using the Website, we at our sole discretion could cancel such orders. We will maintain a list of all fraudulent transactions and customers who have been party to such transactions, and reserve the right to suspend or cancel their registration, deny access to the Website to them, or cancel any orders placed by them.

 

Payments

We only accept orders that have been paid in advance. We will cancel any orders where the full payment has not been made, or where the payment has been cancelled or reversed for any reason whatsoever.

 

We accept payments through multiple methods including credit cards, debit cards, net banking, UPI and popular wallets. Payments can be made in advance into your account, or for each order. All payments are routed through our payment gateway, and we do not store any of your payment information in our databases or any of our other IT systems.

 

Delivery

We accept orders for delivery between 1 to 7 days after order placement. We require you to select a delivery address and block a delivery slot at the time of placing your order. Your order are shipped by us on the same day as the chosen delivery slots for local delivery, and between 2-4 days in advance of the delivery slot for outstation delivery.

It is your responsibility to provide the complete and correct address for the delivery, and to be available to take delivery during your selected delivery slot at the delivery address. 

In the event of your unavailability at the delivery address during your selected delivery slot, we may, at our discretion, make best effort to deliver your order to a nominee communicated by you on the Website at or near your delivery address.

In the event of a non-delivery on account of your non-availability or your failure to allow access of our delivery team to your premises or any other mistake by you (i.e. wrong name or address or any other wrong information) any extra cost incurred by PLANIT for redelivery, including any cost of spoilage of perishable products within your order, shall be claimed from you.
